✦ Contract & Payment Terms
The signed quote will act as contract to ensure clarity and protection for both parties (the quote must be signed before starting the project). The contract covers project scope, usage rights, and delivery schedule.
Payment:
50% upfront to reserve the slot, 50% upon the final delivery.
100% upfront for rush commissions.
Accepted methods: Bank Transfer, PayPal (+7.3% fee).
All payments are in Euro (€). Transaction fees are paid by the client.
The artworks may not be altered, resold, used for AI training, to generate more images, or turned into NFTs.
✦ Ethical Statement
Emeline reserves the right to decline commissions that don’t align with her artistic values.
She does not collaborate with clients who use or support generative artificial intelligence in creative production.

Delay & Project Timeline
The timeframe varies depending on your project’s complexity and Emeline’s current workload. Most projects typically take one or two month (including communication time). It won’t exceed three months for any project, except for large orders involving multiple illustrations.
It would be great if you could plan your order at least one month before the project’s start date. This helps to organize the schedule and ensures to have plenty of time to discuss the art brief and to finalize the quote before to begin. Any urgent deadline will be accommodate depending the availability and the schedule of Emeline.
Terms of Service & Working Agreement
Artist: Emeline Pommery
1. General Overview
These Terms of Service outline the working relationship between the Artist and the Client.
By approving a quote/invoice, the Client agrees to the terms outlined in this document.
2. Scope of Work
Project-specific details (including deliverables, timeline, and pricing) are defined in the corresponding quote/invoice.
Any work requested outside of the agreed scope may be subject to additional fees.
3. Process & Revisions
Projects are completed in stages (e.g. Sketch, Color, Final), with up to 2–3 rounds of revisions per stage included.
Once the sketch stage has been approved, any big major revisions requested will be billed at a rate of 45€/hour.
Minor adjustments remain included within reason.
4. Payment Terms
A 50% deposit is required to secure the booking.
The remaining 50% balance is due upon completion of the project.
Final files will be delivered upon receipt of the final payment.
In some cases:
100% upfront may be required for rush projects.
100% upfront final delivery may be requested for regular clients.

5. Timeline & Delivery
An estimated timeline will be provided at the start of the project.
Timely feedback and approvals from the Client are essential to maintain the schedule.
Delays in communication may result in adjustments to the delivery timeline.
6. Rush Fees
Rush fees are applied to the total project fee (including licensing):
+30% for delivery within 4 weeks
+60% for delivery within 2 weeks
+100% for delivery within 1 week
Rush timelines are subject to availability.
7. Usage & Rights
Usage rights are granted upon full payment, as specified in the quote/invoice.
Unless otherwise agreed:
The Client receives rights to use the artwork for the intended project and its promotion.
The Artist retains full copyright ownership.
The Artist reserves the right to display the work in portfolios, social media, and promotional materials.
- The artworks may not be altered, used for AI training, to generate more images.
Any additional or extended usage may require a separate agreement.
8. Cancellation & Refund Policy
The Client may cancel the project at any stage.
If no work has begun, a full refund will be issued (excluding transaction fees).
If the project is in progress, the Artist will retain payment proportional to the work already completed.
Once the final artwork has been completed, no refunds can be issued.
9. Responsibility & Liability
The Artist is not responsible for delays caused by late feedback, incomplete information, or lack of communication from the Client.
The Client is responsible for ensuring that all provided materials (text, references, etc.) are accurate and authorized for use.
10. Agreement
By approving the quote/invoice, the Client confirms that they have read, understood, and agreed to these Terms of Service.
Project Process
✦ Once you’ve submitted the Commission Form (via the “Waiting List” button), Emeline will reach out to you by email when a slot is open. From there, an art brief will be requested and a tailored quote/invoice will be provided. Once the invoice approved, Emeline will start to work on the project.
On a shared Google Drive folder, you will be able to find each stages files and contract.
Here’s how the process unfolds:
✦ Step 1: Rough Draft
1-3 rough compositions to explore the layout, and the different elements placement. This is the stage for initial feedback and adjustments.
✦ Step 2: Detailed Sketch
Refine chosen composition through a detailed sketch and color sketches. It’s the moment to make major changes if needed. Any big changes after this stage will have additional fees.
✦ Step 3: Lineart/Colors
Creating the final artwork : lineart, colors and lighting. The longest part of the process.
✦ Step 6: Final Details
Finalizing the last details and small adjustment, once the artwork is approved.
✦ Step 7: Delivery File
The final requested file(s) will be delivered in the share folder after the final payement.

The goal of Emeline is to bring your vision to life, to create a piece you truly like. So feel free to ask for adjustments or clarifications during the process..
The communication is primarily through email, though calls can be arranged upon request.
You’ll always be updated on the project’s progress via email. You will find each steps and files in the share google drive folder.
What to include into your Artbrief ?
The details will be asked through the commission form and follow up via email. Feel free to share the information in a Google Doc, PDF you can put directly in the shared drive folder or simply write it directly in our email exchange, whatever works best for you!
Main informations:
- Format (Paperback, ebook …), Size and Use (digital, printed illustrations) you need.
- File Requirements (ex: character with and without background).
Description:
- Character Description : Appearances (colors and shapes), Personality traits
- Scene Description : Setting, Time of Day, Weather, Mood/Atmosphere, Theme, Storytelling, Symbols – elements.
- Action and Composition : What’s Happening? Focus of the Scene, Perspective/Angle Ideas
Visual Reference:
You may do a google doc or share a Pinterest Board.
- Colors/Lighting: Attach or link images showing the color palette or lighting you envision.
- Environment References: Share photos, artwork, or designs that match the setting.
- Character References: Include images of clothing, hairstyles, or specific features.
- Style: Indicate if you prefer a specific art style (e.g., painterly, sketchy, realistic).
Conditions Générales de Vente 🇫🇷
Artiste : Emeline Pommery
1. Présentation générale
Les présentes Conditions Générales définissent les modalités de collaboration entre l’Artiste et le Client.
En validant un devis ou une facture, le Client reconnaît avoir pris connaissance et accepte l’ensemble des termes de ce document.
2. Périmètre de la prestation
Les détails spécifiques du projet (livrables, délais, tarifs) sont définis dans le devis ou la facture correspondante.
Toute demande en dehors du périmètre initial pourra faire l’objet d’une facturation supplémentaire.
3. Processus & Révisions
Les projets sont réalisés en plusieurs étapes (ex. : croquis, couleur, final), incluant jusqu’à 2 à 3 séries de révisions par étape.
Une fois l’étape de croquis validée, toute modification majeure demandée ultérieurement sera facturée au tarif de 45€/heure.
Les ajustements mineurs restent inclus dans la limite du raisonnable.
4. Modalités de paiement
Un acompte de 50% est requis pour réserver le créneau.
Le solde de 50% est dû à la finalisation du projet.
Les fichiers finaux sont livrés après réception du paiement complet.
Dans certains cas :
Un paiement à 100% à l’avance peut être demandé pour les projets urgents.
Un paiement à 100% avant livraison finale peut être demandé pour les clients réguliers.
Moyens de paiement acceptés : Virement bancaire, PayPal (+7,3% de frais)
Tous les paiements sont effectués en euros (€). Les frais de transaction sont à la charge du Client.
5. Délais & Livraison
Un calendrier estimatif est communiqué en début de projet.
Des retours et validations rapides de la part du Client sont nécessaires au bon respect des délais.
Tout retard de communication pourra entraîner un ajustement du calendrier.
6. Frais d’urgence
Les frais d’urgence sont appliqués sur le montant total du projet (licence incluse) :
+30% pour une livraison sous 4 semaines
+60% pour une livraison sous 2 semaines
+100% pour une livraison sous 1 semaine
Les délais urgents sont soumis à disponibilité.
7. Droits d’utilisation
Les droits d’utilisation sont accordés après paiement complet, conformément à ce qui est défini dans le devis.
Sauf mention contraire :
Le Client obtient les droits d’utilisation pour le projet prévu et sa promotion
L’Artiste conserve l’intégralité des droits d’auteur
L’Artiste se réserve le droit de présenter les créations dans son portfolio, ses réseaux sociaux et supports de communication
Les œuvres ne peuvent pas être modifiées, ni utilisées pour l’entraînement d’intelligence artificielle ou la génération d’images.
Toute utilisation supplémentaire ou étendue pourra faire l’objet d’un accord et d’une facturation complémentaire.
8. Annulation & remboursement
Le Client peut annuler le projet à tout moment.
Si aucun travail n’a été commencé, un remboursement complet sera effectué (hors frais de transaction)
Si le projet est en cours, l’Artiste conserve une part du paiement proportionnelle au travail déjà réalisé
Une fois le projet finalisé, aucun remboursement ne pourra être effectué
9. Responsabilités
L’Artiste ne pourra être tenu responsable des retards liés à un manque de communication, des retours tardifs ou des informations incomplètes fournies par le Client.
Le Client est responsable de l’exactitude et de la légitimité des éléments fournis (textes, références, etc.).
10. Accord
La validation du devis ou de la facture vaut acceptation pleine et entière des présentes Conditions Générales.
